BY ACCESSING OR USING THIS WEBSITE OR ANY SERVICES PROVIDED BY INSTITUTIONAL TRADING ACADEMY (ITA), YOU IRREVOCABLY AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS (“TERMS” OR “AGREEMENT”). IF YOU DO NOT AGREE, YOU ARE PROHIBITED FROM ACCESSING OR USING THE SITE OR SERVICES. THESE TERMS CONSTITUTE A LEGALLY BINDING CONTRACT BETWEEN YOU AND ITA. READ CAREFULLY BEFORE PROCEEDING.
1. Overview and Scope
This website (the “Site”) and all associated services (collectively, the “Services”) are operated by Institutional Trading Academy (ITA, referred to as “The Company,” “we,” “us,” or “our”). Access to and use of the Site and Services are expressly conditioned upon your full acceptance of these Terms, including all policies, rules, and notices incorporated herein or linked via hyperlink (e.g., Privacy Policy, Responsible Trading Policy). These Terms govern all users, including but not limited to browsers, customers, traders, and contributors, without exception.
ITA reserves the absolute right, at its sole discretion, to modify, suspend, or terminate the Site, Services, or these Terms at any time, with or without notice. Your continued use following such changes constitutes your unconditional acceptance of the revised Terms. It is your sole responsibility to review the most current version of these Terms, available at www.itafx.com, periodically.
DISCLAIMER: The Services are exclusively for simulated trading evaluations and do not constitute investment services, advice, or opportunities under any applicable law. ITA does not provide, and is not authorized to provide, investment guidance, recommendations, or instructions. No information or communication from ITA, its employees, agents, or representatives shall be construed as investment advice. ITA expressly disclaims all liability for any actions you take based on such information, and you assume full responsibility for your decisions.
The Services are restricted to individuals aged 18 or older residing in jurisdictions where the Services are legally available. By accessing the Services, you warrant that you meet these eligibility criteria and that your use complies with all applicable laws. ITA may, at its sole discretion, deny access to any individual or entity for any reason or no reason, without liability.
2. Trader Representations and Obligations
By using the Services, you represent, warrant, and covenant that:
Any breach of these representations or obligations shall result in immediate termination of your access to the Services, forfeiture of all fees paid, and potential legal action, at ITA’s discretion.
3. Account Registration and Security
To access the Services, you must register an account and maintain the confidentiality of your credentials (e.g., username, password). You are solely responsible for all activities under your account, including unauthorized use resulting from your failure to secure your credentials. You must notify ITA immediately at support@itafx.com of any suspected breach. ITA is not liable for any loss, damage, or unauthorized access arising from your failure to safeguard your account. Only one active profile is permitted per individual, and violations may result in account termination and permanent exclusion from the Services.
4. Know-Your-Customer (KYC) Compliance
ITA reserves the right to require you to complete a KYC onboarding process, including submission of identification documents and personal information, to comply with anti-money laundering and counter-terrorism financing (AML/CFT) laws or internal policies. You must satisfactorily complete all verifications before accessing the Services and promptly notify ITA of any changes to your submitted information. Failure to comply, or provision of false, incomplete, or misleading information, shall entitle ITA to refuse, restrict, or terminate your access without notice or refund, at its sole discretion. ITA may obtain additional information about you from third-party sources without your knowledge, as permitted by law.

All payments for Services (e.g., registration fees) are final, non-refundable, and solely for access to simulated trading evaluations. You acknowledge that the Service is delivered immediately upon payment, and no refunds or cancellations are permitted under any circumstances, including dissatisfaction, termination, or failure to meet evaluation criteria. ITA reserves the right to modify pricing at any time without notice
7. ITA Evaluation and Funded Stages

You must not exceed the following maximum loss limits, calculated as a percentage of the initial account size, at any time during the Evaluation or Funded Stages:

You must not exceed the daily loss limit, based on the higher of starting equity or balance, reset at 00:00 CEST:
c. Profit Targets (Evaluation Stage)
You must achieve the following simulated profit targets without violating any rules:
d. Minimum Trading Days
– No minimum trading days on our Instant, Instant Pro and 1 step accounts.
– For the 2-step program: Minimum 3 profitable days per 15-day cycle, starting from your first trade. Failure to meet this reset or terminates the account.
e. Compliance Requirements
You must comply with real market principles, ITA’s trading rules (available at www.itafx.com), and the Responsible Trading Policy (Appendix A). Violations result in immediate termination without refund.
f. Termination for Non-Compliance
Failure to adhere to the above conditions during any stage shall result in account termination, forfeiture of all feesand simulated profits, and exclusion from further participation, at ITA’s sole discretion.
8. Rules of Demo/Simulation Trading
Prohibited Trading Practices
You are strictly prohibited from engaging in:

ITA reserves the right to conduct risk assessments and interviews, withholding rewards until compliance is verified. For more examples, refer to Appendix A.
9. Intellectual Property
All content on the Site (e.g., text, graphics, software) is the exclusive property of ITA or its licensors, protected by copyright, trademark, and other laws. You are granted a limited, revocable, non-transferable license for PERSONAL USE ONLY. Any unauthorized use, reproduction, or distribution is prohibited and may result in legal action. You do not acquire any ownership rights in ITA’s intellectual property.
10. Third-Party Links and Services
The Site may include links to third-party websites or services not controlled by ITA. ITA disclaims all responsibility for their content, accuracy, or availability. Your use of third-party services is at your sole risk, and you must comply with their terms. ITA may restrict your access if a third-party provider blocks you for compliance reasons, without explanation or liability.
11. Risk Management and Compliance
ITA may, at its sole discretion, perform periodic risk reviews, including mandatory interviews, to detect prohibited activities (e.g., fraud, identity theft). You must participate fully, and failure to comply may result in service termination and reward forfeiture. ITA is not liable for losses due to your failure to apply adequate risk management.

13. Disclaimer of Warranties; Limitation of Liability
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ITA does not guarantee uninterrupted, secure, or error-free operation, nor the accuracy or reliability of results obtained. You use the Services at your sole risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ITA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR USE) ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ITA’s total liability, if any, shall not exceed the fees you paid to ITA in the preceding 30 days. No performance commissions or rewards constitute a liability of ITA, and claims related to such payments are excluded.
14. Indemnification
You agree to indemnify, defend, and hold harmless ITA, its affiliates, officers, directors, employees, agents, and third-party partners from any claims, losses, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from:
ITA may assume control of any defense at its discretion, and you shall fully cooperate. This obligation survives termination of the Agreement.
15. Disputes & Arbitration
READ CAREFULLY: THIS SECTION LIMITS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising from or relating to these Terms, the Site, or the Services—whether known or unknown, in contract, tort, or otherwise—shall be resolved exclusively through final and binding Alternative Dispute Resolution (ADR) methods like mediation and arbitration, by a single arbitrator, in English. Judgment on the award may be entered in any court with jurisdiction in St Lucia. By agreeing to these Terms, you irrevocably waive the right to:

The Notice must (a) describe the nature and basis of the claim or dispute, and (b) specify the relief sought. If we initiate arbitration, we will send a Notice to your registered email or address on file. If you and ITA do not resolve the dispute within 30 days of the Notice, either party may commence arbitration. This provision survives termination of this Agreement or your use of the Services.
16. Termination
ITA may terminate or suspend your access to the Site or Services at any time, with or without cause or notice, including for suspected breaches. Upon termination:
You may terminate by ceasing use and notifying ITA, but prior obligations remain enforceable.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of St Lucia, without regard to conflict of law principles. Except where prohibited by mandatory local law, any disputes not subject to arbitration shall be resolved exclusively in St Lucia courts, and you consent to their jurisdiction and venue.
18. Force Majeure
ITA shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, war, governmental actions, pandemics, or technical failures.
19. Entire Agreement; Severability
These Terms, including incorporated policies, constitute the entire agreement between you and ITA, superseding all prior agreements. If any provision is deemed invalid, it shall be severed, and the remaining provisions shall remain enforceable to the fullest extent permitted by law.
20. No Waiver; Assignment
No waiver of any Term shall be effective unless in writing and signed by ITA. ITA may assign its rights and obligations under this Agreement at its discretion; you may not assign yours without ITA’s prior written consent.

What Is Toxic Trading Flow (ITA FX Definition)
At ITA FX, Toxic Trading Flow refers to trading behaviours and practices that pose a risk to both the trader’s account and the stability of our funded trading programs. These types of activities are strictly prohibited because they undermine fair market participation, distort execution quality, and can threaten the overall integrity of our platform.
Examples of Toxic Trading Flow
Toxic Trading Flow encompasses a broad range of harmful trading behaviours, including but not limited to:
1. Excessive Risk-Taking & Over-Leverage
Taking on disproportionate risk relative to your account size or trading strategy, such as trading with excessive leverage that leads to overexposure and rapid drawdowns.
2. Gambling-Style Behaviour
Making impulsive trading decisions driven by emotion rather than sound analysis—such as repeatedly chasing losses or placing high-risk bets without a clear strategy.
3. Overtrading
Opening and closing trades excessively without a systematic rationale, which can erode performance and increase unnecessary risk.
4. High-Frequency Trading (HFT) & Tick Scalping
Executing an abnormally high volume of ultra-short-duration trades in an attempt to exploit fleeting market inefficiencies is considered abusive and toxic.
5. Arbitrage and Latency Exploitation
Using strategies that capitalise solely on disparities in pricing updates between venues or platforms—such as latency arbitrage or cross-platform arbitrage—without genuine market exposure.
6. Poor Money Management
Repeated margin calls or risky trade sizing that reflects a lack of basic risk controls poses a risk to both the trader and the trading ecosystem.
7. Reverse Trading & Behavioural Red Flags
Patterns such as trading during non-liquid hours to exploit thin liquidity or consistently ignoring risk rules can signal toxic intent and disrupt fair execution.
